K-Electric Sindh High Court NEPRA Multi-Year Tariff FY2024-30
✧ GENERATE BRIEFING

The Sindh High Court has granted crucial interim relief to K-Electric (KE) by suspending contested regulatory notifications and orders stemming from a prolonged dispute over the power utility’s Multi-Year Tariff (MYT) for FY2024–FY2030. In a disclosure to the Pakistan Stock Exchange (PSX), KE confirmed that the court issued ad-interim orders on October 7, 2026, halting the enforcement of judgments passed by the NEPRA Appellate Tribunal on September 23, associated NEPRA review determinations, and subsequent implementation notifications issued by NEPRA and the Ministry of Energy’s Power Division. The core of the legal dispute centers on the boundary of regulatory review: KE contends that while the National Electric Power Regulatory Authority (NEPRA) possesses review powers, these cannot legally constitute a wholesale re-determination of the tariff. The company argued that NEPRA’s review determinations—initially passed on October 20, 2025, and officially notified on September 23, 2026, alongside a Ministry of Energy notification on September 27—inflicted severe financial distress and rendered the MYT framework economically unsustainable.

The Sindh High Court has granted interim relief to K-Electric (KE) by suspending orders and notifications arising from a dispute over the power utility’s multi-year tariff, temporarily preventing the challenged regulatory decisions from taking effect.

KE disclosed to the Pakistan Stock Exchange that the court issued ad-interim orders on October 7, 2026, after the company challenged judgments of the NEPRA Appellate Tribunal dated September 23, along with NEPRA’s review determinations and subsequent notifications issued by NEPRA and the Ministry of Energy’s Power Division.

The dispute relates to KE’s Multi-Year Tariff (MYT) for FY2024 to FY2030. KE has argued that while NEPRA has the authority to review a tariff determination, the review process cannot effectively amount to a fresh determination of the tariff.

KE further maintains that NEPRA’s review determinations had a substantial adverse impact on its MYT and made the tariff framework financially unsustainable for the company. The company had previously disclosed that the NEPRA Appellate Tribunal dismissed its appeals against the regulator’s decisions on September 23.

The challenged regulatory decisions include NEPRA’s review determinations dated October 20, 2025, which were subsequently notified on September 23, 2026. The Ministry of Energy’s Power Division also issued a related notification on September 27, 2026.

Legal Proceedings and Financial Implications

The High Court has issued notices to NEPRA and other respondents and fixed the matter for further hearing on October 15. The court’s interim order does not finally decide the tariff dispute but temporarily suspends the impugned orders and notifications while the legal challenge is considered.

The dispute is significant for KE because the MYT determines the regulatory framework for its operations over several years. Any changes to the tariff structure can affect the company’s revenues, cost recovery, investment planning and financial sustainability.

The latest development also comes amid wider efforts to improve regulatory predictability in Pakistan’s power sector. The government is reviewing the sector’s regulatory framework as it seeks to encourage investment, improve efficiency and address changing electricity demand patterns.
